Terms and Conditions

Please take a look at our Terms and Conditions, as it is essential for you to inform us of any expectations of your own you wish to be included before any works commence.

 

​​​In these terms and conditions:​

  • "We", "us" or"our" refers to Colegate & Attridge.

  • "Client" refers to the individual(s) or organisation interested in the services of Colegate & Attridge.

  • "Estimation" refers to an informal estimate of the cost of works.

  • "Quotation" or "quote" refers to a formal offer of the cost of works.

1   Estimations

1.1 An estimation is an informal approximation of the cost of works provided by us to the client.

1.2 This is not a formal quotation of the cost of works and is subject to change.

1.3 Estimations may be provided to the client in a number of forms, including a hard copy document, electronic document and via email, or verbally over the phone or face-to-face. Any verbal estimation provided by us will be confirmed by written or electronic means of communication.

1.4 We reserve the right for an estimation price to be revised if unforeseen circumstances are encountered, which in turn may lead to greater costs being incurred by us.

2   Quotations

2.1 A quotation is a formal offer of the cost of works must by us to the client.
2.2 We provide quotations for works on a bespoke basis. Each quote we provide the client is done in as much detail as reasonably possible, so as to avoid any misunderstanding.
2.3 If something is missing from any quotation we provide and we are notified of such by the client prior to the commencement of works, we will revise the quote accordingly.
2.4 All quotations are only provided to the client in the form of a hard copy document, electronic document, or via email.
2.5 We reserve the right for a quotation price to be revised if unforeseen circumstances are encountered prior to the commencement of works, which in turn lead to greater costs being incurred by us.
2.6 All quotations are calculated on the assumption of the principle of unimpeded accessibility at the site of works, unless otherwise agreed with the client.
2.7 Extra works may be agreed upon after the commencement of works and the client will be charged at the agreed rate, after both verbal discussion and confirmation of the additional agreement by written or electronic means of communication.
2.8 The client reserves the right to withdraw from a quotation prior to the commencement of works.
2.9 In the event of the client withdrawing from the quotation prior to the commencement of works, we reserve the right to withhold any deposit already paid by the client.

3   Site Arrangements

3.1 To ensure both minimal disruption to the client and for works to be carried out by us, practical arrangements will be agreed upon prior to the commencement of said works.
3.2 Access will be required at all times throughout the agreed working hours, unless otherwise agreed with the client, as well as remaining in place for the collection of all surplus materials, including waste materials, plant and equipment until full and final payment is both made and received.
3.3 We reserve the right to employ additional labour and/or subcontractors. Whilst each individual working on site takes full responsibility for their own third party liability, we will oversee all works to completion and accept full responsibility for any works completed.

4   Ownership of Works

4.1 The product of all works and other materials provided by either us or our subcontractors remain the property of Colegate & Attridge until full and final payment is both made and received, unless agreed otherwise.
4.2 After the client makes the final payment and it is received by us, the client takes ownership of the completed works, and the materials used to carry out said works only.
4.3 All surplus materials, including waste materials, remain our property after both the client making the final payment and us receiving said payment.

5   Payment

5.1 Payment can be made be made by the client via bank transfer, cheque or in cash. A receipt will always be provided upon payment.
5.2 Payment in full is due upon the completion of works. At this point, we will provide the client with a final invoice.
5.3 Details for bank transfer payment will be provided on said invoice.
5.4 Any and all cheque payments must be made payable to ‘Colegate & Attridge’.
5.5 Any cash payments must be made in person to Luke Attridge, unless agreed otherwise.
5.6 Deposits and part and interim payments are agreed with the client prior to the commencement of works.
5.7 We reserve the right to demand deposit or an element of upfront payment in the event of expensive materials being required for the works and in other scenarios.
5.8 If payment is not paid in full upon the completion of works, we reserve the right to recover all costs owed by the client.

6   Insurance

6.1 We have Public Liability Insurance, provided by Direct Line up to the sum of £2,000,000.
6.2 We have Employer’s Liability Insurance, provided by Direct Line up to the sum of £2,000,000.
6.3 Our insurance policies cover all ordinary building practices in principle.

7   Responsibilities

7.1 We accept no responsibility for the presence of any unsound existing structures, regardless if they are detected or undetected prior to the commencement of works and is the responsibility of the client.
7.2 Whilst we always endeavour to protect surfaces, such as floors, furniture, etc. with the use of sheeting, as well as stringent and considerate working practices, we accept no responsibility for any damage to existing surfaces, furniture, etc. and is the responsibility of the client.
7.3 It is our responsibility to complete all works as soon as possible without sacrificing quality, taking into account uncontrollable events, included by not limited to, availability of materials, severe weather, epidemic or other natural disaster, war, civil unrest, or failure of telecommunication networks.

8   Entire Agreement

8.1 These Terms and Conditions constitute the entire agreement between us and the client, superseding any previous promises and agreements.

8.2 The acceptance of a quotation, estimation and agreeing to the commencement of works by the client triggers these Terms and Conditions to come into effect.

8.3 We reserve the right to terminate works with immediate effect if the client is in breach of these Terms and Conditions.

8.4 Third parties have no right to enforce any of these Terms and Conditions.

8.5 Nothing in these Terms and Conditions will affect legal rights of the client. The Citizens Advice website can be accessed for more information.

9   Data Protection

9.1 All information we collect from the client will be retained in accordance with both the Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

9.2 All client details will remain confidential.

9.3 We reserve the right to communicate with the client after works have been completed, in accordance with our Privacy Policy.
